If you believe the tow was unjustified, gather photographs and witness statements immediately. These support wrongful towing claims effectively.
Understanding Your Rights When Wrongfully Towed
Not all tows are justified. Your vehicle can only be removed legally if proper signage exists and parking restrictions are clearly marked. If you were unaware of restrictions or signs were absent, you may have grounds for a wrongful towing dispute. Contact the towing company first with any photographic evidence. Request documentation showing why the tow occurred and what signage was visible at the time.
Inner West Council maintains strict guidelines about when vehicles can be removed. If you believe your rights were violated, file a formal complaint with the council and the towing operator. Keep all communications, receipts, and photographs organized chronologically. Disputes often resolve through documented correspondence, but escalation to compensation claims may become necessary if damages occurred. Having clear evidence (timestamps, photos, witness names) strengthens your position significantly and speeds resolution considerably.
Towing Costs Breakdown and Payment Options
Understanding the fee structure helps you budget for recovery and prevents surprise charges later. Release fees average $300, though private property tows may vary based on the property owner's agreement with the towing company. Daily storage charges run approximately $50 per day, accumulating quickly if your vehicle sits in the yard longer than necessary. Some operators charge administrative fees as well, typically $30–$50, for processing paperwork and documentation.
Most towing companies in Marrickville accept multiple payment methods to maximize accessibility. Credit cards, debit cards, direct bank transfers, and cash payments are standard. Some operators offer payment plans for larger amounts, though interest may apply. Always request an itemized receipt showing each charge separately. This protects you if disputes arise later. Compare quotes from different local providers before committing; rates can vary by $50–$100 between operators.
